NationPoint Privacy Policy
We are advising you of NationPoint's Privacy Policy to explain our treatment of personal information throughout our organization. NationPoint is a division of First Franklin Financial Corporation. 1
If specific laws, rules or regulations require NationPoint to provide you with additional or different privacy-related rights beyond what is set forth in this Policy, then we will comply with those specific laws, rules or regulations.
This Policy covers the personal information of current and former individual NationPoint customers. In addition, this Policy covers the personal information of other individuals with whom NationPoint has an existing or prospective relationship where such protection is required by applicable laws, rules or regulations.
In this Policy, "personal information" refers to any "nonpublic personal information" as defined under the Gramm-Leach-Bliley-Act, which generally includes, but is not limited to, nonpublic information that you provide to us or that we obtain about you in connection with the customer relationship.
Personal Information We Collect
Based on our relationship with you, we collect personal information from and about you that is relevant and appropriate under the circumstances. For example, we may collect or verify personal information from or about you in the following ways:
- From loan documents, applications, forms, communications and other interactions, information including your name, address, email address, telephone number, Social Security or other identification number, income, source of funds and other financial information.
- From your loan history with NationPoint or from our affiliates or prior loan servicer.
- From entities outside NationPoint ("nonaffiliated third parties"), information including your creditworthiness/credit history and identity. These nonaffiliated third parties may include, but are not limited to, consumer/credit reporting agencies, tax authorities, information available in the public records and insurance companies.
Use of Personal Information
We use personal information to operate our business in a prudent and efficient manner. Without limitation, we may use this information in the following manner:
- To provide you with products and services that you have requested.
- To respond to inquiries and requests or to resolve disputes.
- To attempt to prevent fraud and to allow us and your original lender to perform risk control.
- To verify your identity.
- To verify information related to the collateral securing a loan, such as insurance coverage and property taxes.
- To obtain asset and obligation information.
- To comply with legal and regulatory requirements in accordance with applicable laws, rules and regulations.
- To otherwise conduct business and service your loan.
Sharing Personal Information with Affiliates
In connection with the uses described above, we may, depending on the nature of your relationship with us, share some or all of your personal information with our affiliates. You may have the right to instruct us not to share certain eligibility information, such as certain loan application or credit eligibility information, with our affiliates. Please note that, even if you exercise this option, we may still share this information with our affiliates when they are assisting us in serving you and we may continue to share transaction and experience information with our affiliates. Sharing Personal Information with Nonaffiliated Third Parties
NationPoint does not rent or sell personal information. In connection with the uses described above, we may share some or all of the personal information we collect with nonaffiliated third parties as allowed by law or to assist us in servicing and administering your loan.
These nonaffiliated third parties may include:
- Persons who own or have a financial interest in your loan and their agents;
- A new loan servicer resulting from the sale or transfer of your loan;
- A consumer/credit reporting agency;
- An insurance company that may provide coverage to protect the interest in the secured property;
- Entities in response to a subpoena or other court order;
- To professional service organizations or other service providers used to perform services on our behalf; or
- To third parties that perform marketing services on our behalf or to other financial institutions with whom we have joint marketing agreements in order to make various financial services available to you. These third parties must agree to strict confidentiality provisions to assure the protection of the personal information.
Among other things, these nonaffiliated third parties are entitled to receive this information because they:
- Help us carry out activities related to the servicing of your loan;
- Mail billing statements and other information;
- Help us verify information, including your identity;
- Provide us with consulting, accounting, audit, legal and other professional services;
- Help us develop, operate and maintain our services and systems.
Confidentiality and Security of Personal Information
People. We educate our employees to treat personal information with care, and work to limit access to this information to individuals who need it for the purposes stated in this Policy.
Policies and procedures. We maintain and monitor our physical, electronic and procedural safeguards to comply with applicable regulations, updating them as needed to protect personal information.
Accuracy of Personal Information
We endeavor to keep our records of your personal information current and complete. If you become aware of any discrepancies in your personal information, please notify us and we will make the necessary corrections.
Special Note for Vermont Residents
Vermont Residents: If your primary address on our records is in Vermont, then we will not share eligibility information with our affiliates for their use unless you "opt in" or affirmatively consent for us to do so by calling (800) 346-6437. We are permitted to share information which is not a credit report under Vermont law without your consent, such as information related solely to our transactions and experiences with you.
